Welcome to Aveliq. These Terms and Conditions govern your use of the Aveliq online store and website and any purchases made through our online store.

By accessing or using our website, placing an order, or purchasing products from us, you agree to these Terms and Conditions.

1. ABOUT AVELIQ

Aveliq is an online store offering beauty, skincare, self-care, and related products to customers in South Africa.

Our website is hosted and powered by Shopify, which provides the e-commerce platform through which we sell our products.

All purchases made through the Aveliq website are transactions between the customer and Aveliq. Shopify provides the technology platform but is not the seller of Aveliq products.

2. USING OUR WEBSITE

You must not use our website for any unlawful purpose or in any way that may damage, disable, or interfere with the website or the experience of other customers.

Certain Aveliq products may be intended for personal skincare, beauty or self-care use.

Customers should read the product description, instructions, warnings and usage information before using a product.

Where a product requires a patch test or other precaution, customers are encouraged to follow the manufacturer's instructions.

Aveliq does not provide medical advice. Our products and product information are not intended to diagnose, treat or cure any medical condition unless expressly stated and lawfully permitted.

Customers should discontinue use of a product if they experience an adverse reaction and seek appropriate professional advice where necessary.

5. PRICES

All prices displayed on the website are in South African Rand (ZAR), unless otherwise stated.

Prices may change from time to time, but a price change will not affect an order that has already been accepted and paid for, subject to any correction of an obvious pricing error permitted by law.

Where applicable, taxes will be handled in accordance with South African tax legislation.

Any delivery charges will be displayed before the customer completes the purchase.

6. ORDERS

When you place an order through our website, you are making an offer to purchase the selected products.

You will receive an order confirmation after placing your order. An order will be regarded as accepted once Aveliq has confirmed the order and payment has been successfully received, subject to our rights under applicable law.

We reserve the right to cancel an order where:

• a product is unavailable;
• there has been an obvious pricing or product-description error;
• payment has not been successfully received;
• we reasonably suspect fraudulent or unauthorised activity; or
• cancellation is otherwise permitted by applicable law.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.

7. PAYMENT

Payments may be processed through payment providers made available on our Shopify store.

Where Ozow card payments are available, customers may be able to pay using supported credit or debit cards.

Aveliq does not store customers' full card details. Payment information is processed by the relevant payment provider in accordance with its security and privacy practices.

We reserve the right to verify payment and transaction information where reasonably necessary to prevent fraud or unauthorised transactions.

8. SHIPPING AND DELIVERY

We deliver orders within South Africa using our nominated courier or delivery service.

The available delivery options, charges and estimated delivery periods will be displayed during checkout or communicated to the customer.

Delivery times are estimates and may be affected by courier delays, public holidays, weather, unforeseen circumstances or events outside our reasonable control.

Aveliq will take reasonable steps to ensure that orders are properly packaged and handed to the nominated delivery service.

Nothing in these Terms and Conditions excludes or limits any consumer rights relating to delivery or the risk in goods that cannot lawfully be excluded under South African law.

Where a delivery date has been specifically agreed, we will make reasonable efforts to meet that date.

9. RETURNS, REFUNDS AND EXCHANGES

Returns and refunds are handled in accordance with our Refund and Returns Policy and applicable South African consumer legislation.

Nothing in our Refund and Returns Policy or these Terms and Conditions is intended to remove or restrict any right that a consumer has under the Consumer Protection Act or other applicable South African law.

Where a product is defective, unsafe, not of the required quality, does not correspond with its description, or another statutory consumer right applies, the customer may be entitled to a remedy as provided by law.

Certain products may be subject to lawful hygiene-related return restrictions where they have been opened or used.

10. CANCELLATION OF ONLINE ORDERS

Where a statutory cooling-off or cancellation right applies to an online transaction, Aveliq will honour that right in accordance with applicable South African law.

The Electronic Communications and Transactions Act provides specific cancellation rights for qualifying electronic transactions, subject to its requirements and exceptions.

Nothing in these Terms and Conditions limits a consumer's statutory cancellation rights.

Where a customer cancels an order in circumstances where no statutory cancellation right applies, the cancellation will be dealt with in accordance with our Refund and Returns Policy and applicable law.

11. REFUNDS

Where a refund is approved, it will generally be made using the same payment method used for the original transaction, where reasonably possible.

The time required for the refund to reflect in the customer's account may depend on the payment provider or bank.

Where a refund is required by law, Aveliq will process the refund within the applicable legal period.

12. INTELLECTUAL PROPERTY

All content appearing on the Aveliq website, including our logo, brand name, photographs, graphics, written content, product descriptions, designs and other original material, is owned by or licensed to Aveliq unless otherwise stated.

Nothing in these Terms and Conditions limits liability for fraud, gross negligence, wilful misconduct or any other liability that cannot legally be excluded.

18. EVENTS OUTSIDE OUR CONTROL

Aveliq will not be responsible for delays or failure to perform an obligation where this is caused by circumstances beyond our reasonable control, including natural disasters, severe weather, strikes, courier disruptions, power failures, internet failures, government action or other events that could not reasonably have been prevented.

We will take reasonable steps to minimise the impact of such events.
